The Various SSD Appeals Options

If your application for SSD benefits has been denied, there are four different stages of appeals you can pursue which include:

  • Reconsideration request
  • Appeals hearing before an administrative law judge
  • Appeals Council review
  • Federal Court Appeal

If you disagree with your initial denial of benefits, you can request a reconsideration determination, which will be conducted by a Social Security official who was not involved in the original decision.

Next, if you wish to appeal the reconsideration decision, you can ask for a hearing with an administrative law judge (ALJ).  You can even request further review by the Appeals Councilif you disagree with the opinion of the ALJ.  If the Appeals Council refuses to hear your case, or if it decides against you, you may be able to file a suit in federal court.
